Terms & Conditions

These terms apply to every purchase on sunbiotech.pro. By placing an order, you accept them. The seller is Sunpower Biotech Private Limited (details at the end of this page).

1. Who can buy

You must be 18 or older and have a delivery address in India. We sell only within India.

2. Products

ProGrow Living Potting Mix is made from cocopeat, vermicompost, perlite and red soil with mycorrhiza, Trichoderma and beneficial bacteria. Its colour, texture, smell and moisture can vary from batch to batch. Pictures on the website are for illustration only.

3. Use and safety

Use ProGrow products for gardening only. Do not eat them. Keep them away from children and pets. Wash your hands after use.

4. Shelf life

ProGrow Living Potting Mix has a shelf life of 2 years. For best results, use it within 1 year.

5. Results

Plant growth depends on many things we do not control, such as the plant variety, light, water, climate and care. We do not guarantee any particular result.

6. Prices

• Prices are in Indian rupees. The product price includes GST.
• The MRP is the maximum retail price, inclusive of all taxes.
• Shipping is charged separately. You see the shipping charge at checkout before you pay. It already includes GST (18 % at present).
• Prices may change. The price shown when you place the order applies to that order.

7. Orders

Your order is an offer to buy. We may refuse or cancel an order, for example if the product is out of stock, the price or description is wrong, the PIN code is not serviceable or we suspect fraud. In that case we refund the full amount you paid.

8. Payment

We accept online payment through Razorpay: UPI, cards and net banking. No extra fee is charged at checkout. Cash on delivery is not available. Razorpay’s terms also apply to your payment. We email you an order confirmation, and Razorpay sends you the payment receipt.

9. Cancellation and returns

All sales are final. You cannot cancel an order after the payment is complete, and you cannot return or exchange a product, except in the cases listed in our Refund & Cancellation Policy.

If a product arrives damaged or has a manufacturing defect, we replace it free of charge or, if you prefer, refund its price. You do not need to send it back. Tell us within 48 hours of delivery, with photos or a video.

10. Delivery

See our Shipping Policy. Delivery dates are estimates. Risk in the products passes to you on delivery.

11. Limitation of liability

To the maximum extent the law permits:

• our total liability for any claim connected with an order is limited to the amount you paid for that order;
• we are not liable for indirect or consequential loss, including loss of plants, crops, income or profit.

Nothing in these terms limits your rights under the Consumer Protection Act, 2019 that a contract cannot limit.

12. Reviews

If you post a review, it must be honest and based on your own experience. We may refuse or remove reviews that are false, offensive or unrelated to the product. We do not publish paid or fake reviews.

13. Messages and personal data

We send order messages by email. Razorpay and our courier partners may also contact you about your payment or delivery. We send offers and news by email or WhatsApp only if you agree, and you can unsubscribe at any time. How we handle your personal data is described in our Privacy Policy.

14. Intellectual property

The ProGrow name and logo, and the texts and pictures on this website, belong to us or are used with permission. Do not copy them without our written permission.

15. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, for example natural disasters, extreme weather, strikes, transport disruptions or government orders.

16. Governing law

These terms are governed by the laws of India. Subject to your rights under consumer protection law, the courts in Goa have jurisdiction.

17. Grievances

If you have a complaint, contact our Grievance Officer. We acknowledge every complaint within 48 hours and give you a complaint number to track it. We resolve it within one month of receiving it.

18. Changes

We may update these terms. The version published on the day you place an order applies to that order.
